When we start reading the Indian Constitution, the very first thing that we read is the Preamble. It starts with strong words: “We, the people of India.” and four fundamental ideals — Justice, Liberty, Equality, and Fraternity. Anyone reads this and they feel it just wonderful words. But these are not wonderful words only they are the very lifeblood and heart of our Constitution and the pillars of our democracy.
Let us distinguish between what they are and why they are so important in actual life.
- Justice: Beyond Courts
Preamble’s justice is not judicial justice alone. It encompasses:
Social justice – eradication of discrimination on caste, gender, or economy.
Economic justice – equal opportunity and equal pay for all.
Political justice – all citizens are entitled to voting rights and representation in the government.
For instance, the system of reservations is one of the ways through which the government attempts to provide social justice to socially backward classes. Economic justice is provided by the Equal Remuneration Act through equal remuneration for equal work.
- Liberty: Freedom With Responsibility
Freedom in the Preamble implies freedom for citizens to:
Think freely
Express themselves
Follow any religion
Choose their own path
This is guaranteed by Articles 19 to 22 of the Constitution. But freedom does not imply that we can do anything we like; it mustn’t hurt other people. So, for instance, you can speak your mind, but you can’t inspire hatred or tell a falsehood.
- Equality: Levelling the Playing Field
Equality means:
No one is bigger or smaller than anyone else in the law.
All have to be treated equally on no grounds of caste, gender, religion, or origin.
They are governed by Articles 14 to 18. A good example is prohibition of untouchability by Article 17. Another is Right to Education (Article 21A), which makes an attempt at providing a fair chance to all children in life.
Despite this fact, there are social inequalities. It is for this reason that power is conferred upon the State by the Constitution to enact an act which enables the upliftment of the backward classes.
- Fraternity: Brotherhood Which Unites Us
Fraternity implies that there must be a feeling of brotherhood existing amongst all Indians. It includes:
There is unity in diversity
Respect for the dignity of every human being
National integration, particularly in a country which is as diverse as India
Particularly so in today’s world when it’s all so easy to disregard being at variance over religious, linguistic, or geographical differences. Every citizen and the king himself are tied by the very Constitution to maintain harmony.
Why These Words Still Matter
Preamble values are not rhetorical ideals. They are ideals to which the Constitution still calls us. Judges also refer to the Preamble in the ordinary course of construing statutes in a constitutional ideals frame of mind. Example:
In Kesavananda Bharati (1973), the Supreme Court held the Preamble to be a part of the Constitution’s “basic structure” — one which cannot even be altered by Parliament.
The court in Navtej Johar (2018) asserted that it was re-imposing equality, justice, and freedom on LGBTQ+ citizens since homosexuality had come to be legalised.
The Preamble is not a literary introduction; it’s a vision statement. It says what kind of society we’re working to create: a society that is equal, free, just, and united. As citizens, not only do we have the right to exercise these rights, but it’s our responsibility to defend and maintain them in deed, word, and action.
Essentially, the Preamble isn’t being spoken; it’s an open vow to ourselves and the generations that follow.
